We provide advice to our clients in all stages of their real estate projects. Initial activities involve project structuring and the drafting of transaction documents, contracts with planners, expert specialists and the professionals needed to execute the work (eg contracts for construction services, architect contracts and general contractor agreements), but also agreements with banks and investors providing the necessary funds. Our office supports both investors and banks in carrying through investment projects, but also assists principals and contractors in setting up and negotiating the contractual framework for the services to be provided, in facilitating follow-on offers and in the event of billing disputes, warranty issues and claims for damages.
In real estate law, we advise retail clients as well as institutional clients on the purchase and sale of real property, commercial real estate, apartment buildings, shops or private homes, but also in matters relating to the reappraisal of a property’s net internal area and property partitioning. Since real estate transactions often take the form of corporate transactions, our interdisciplinary team of specialists has ample expert knowledge in corporate and M&A law. Our services in building and real estate law include advice on all issues related to domicile law. The development of residential and commercial properties involves aspects of tenancy law, residential property law, land register law and real estate property partitioning law as well as specific issues relating to the operation and management of shopping centres or apartment buildings. In all these projects, we draw on the expert knowledge of our Public Construction team and our Environmental & Technology team for all public-law proceedings – from redesignation and plant permitting procedures all the way to building law matters.
