EIA Law in Practice

The annual practical seminar hosted by the Austrian Water and Waste Management Association (ÖWAV) once again takes on the task of bringing you up to date on the latest legislation and jurisprudence. You will learn first-hand about the current status of the next amendment to the EIA Act and the latest developments in EU law, and will be informed about the recent rulings of the Federal Administrative Court and the Supreme Administrative Court.

Other presentations will focus on the issue of cumulation, which is particularly relevant for EIA practice, the new legal framework for the accelerated expansion of renewable energies, changes and deadline extensions for approved EIA projects, and the exclusion of suspensive effect in appeal proceedings – an increasingly important issue given the often lengthy duration of such procedures.

The event will take place on November 13th, 2025, in cooperation with the Federal Ministry for Climate Action, Environment, Energy, Mobility, Innovation, and Technology, Niederhuber & Partner Attorneys-at-Law GmbH, and Haslinger / Nagele Attorneys-at-Law GmbH.

As part of the event, in “Session 3: Current Legal Issues,” starting at 3:10 p.m., Mario Laimgruber and Raffael Huprich from the Upper Austrian State Government will present on the topic of “Targeted Management of Conditions and Modifications for Successful Project Implementation – from Both the Authority’s and the Developer’s Perspective.” At 3:50 p.m., Wolfgang Berger and Anna Obereder will speak on the topic of “Exclusion and Granting of Suspensive Effect in EIA Proceedings.” “Session 2: Accelerating the Expansion of Renewables” will be moderated by Wilhelm Bergthaler.
