Triple expertise in RdU and ZVG


In the latest issue of the specialist journal Recht der Umwelt – RdU (RdU – “Law of the Environment”), Mario Laimgruber and Maurizio Stoisser examine the topic “Restoration vs. Renewable Energy.” In the Zeitschrift für Verwaltungsgerichtsbarkeit (ZVG – “Journal for Administrative Jurisdiction”), Mathis Fister publishes an article on “Private Parties Subject to Disclosure under the New Freedom of Information Act,” and the News Radar was authored by Sophie Rimser.

1. Restoration vs. renewable energy: the Gordian knot of ecological goal conflicts and its potential impact on project approval procedures – Mario Laimgruber; Maurizio Stoisser

In environmental policy, the European regulations on the legal framework for nature restoration under the Restoration Regulation represent one of the most significant issues for the developments that will affect us all in the coming years. Many questions remain open in detail. This article analyzes how the expansion of renewable energy is considered within the Restoration Regulation and, on this basis, offers approaches to answering a question of utmost practical relevance: What does the Restoration Regulation mean for my renewable energy project?

2. Private parties subject to disclosure under the New Freedom of Information Act Mathis Fister

In accordance with Art. 22a para. 3 of the Federal Constitution Law (B-VG) and section 4 of the Freedom of Information Act, “private parties subject to disclosure” will also be required to provide (limited) information in the future. This article offers an initial review and analysis of the relevant provisions, using public enterprises as an example.
