Water Law for Practice – Focus on Energy Transition


On April 7th, 2022, the ÖWAV seminar “Water Law for Practice” will take place with the cooperation partner Haslinger / Nagele.

In addition to dealing with the most important legal innovations and envisaged legislative projects at the national and EU law level as well as the current water law case law, one of the main topics will be the energy transition.

Wolfgang Berger and Mario Laimgruber will give a lecture on the basis of their ongoing proceedings on the modification of permits in times of the energy trasition a hot topic these days which deals in particular with the consideration and evaluation of the public interest in the generation of renewable energy in relation to other public interests in water law proceedings. The underlying question of whether the generation of renewable energy or, for example, ecological or nature conservation aspects should be given a higher degree of consideration, naturally goes far beyond purely water law issues. Strictly speaking, this affects every project that can contribute to the energy transition but whose realization naturally also has an impact on the environment (in addition to projects that are intended to generate renewable energy, this question also affects projects with which the necessary network infrastructure is to be established and, in general, network projects with which new technologies, e.g. for CO2 reduction and the associated positive effects in terms of climate change, are made possible in the first place).
