RED III implementation & RED III as an opportunity 


In the latest issue of the specialist journal Recht der Umwelt (RdU), Mario Laimgruber, together with Christoph Ortner and Sandro Gaugg (both Austrian Power Grid AG), explores the topic “RED III as an Opportunity for Austria – Using the Example of the Electricity Transmission Network.” Austria needs a secure and demand-oriented electricity supply. For the energy transition, rapid grid expansion is indispensable, but it brings legal and technical challenges. Integrating current EU requirements (RED III) into national law can facilitate this expansion – provided that experiences from previous projects are incorporated into a coordinated overall package. The article uses selected examples to show which concrete opportunities should be utilized to best fulfill the societal mandate of “secure electricity supply.”

Wilhelm Bergthaler, together with Martina Prechtl-Grundig (Managing Director of the umbrella association Renewable Energy Austria), examines “RED III Implementation – All Lights on Green!” The energy transition needs acceleration – both practically and legally – because its urgency is growing. The legislative measures required for the transformation are outlined and defined by the RED III, but implementation is lagging behind. There are many reasons for this – some of them quite justified.

In addition, Wilhelm Bergthaler addresses the topic “Competence Law Options and Models of Citizen Participation for RED III Implementation” in the editorial. Those who aim to accelerate procedures must concentrate them. How are competences distributed in this regard? And, how can a balance be achieved between public participation and procedural acceleration? The article offers options in the form of an “EIA light” and a new citizen participation procedure.
