Detours to COVID subsidies?

As already reported previously, the exclusion of certain companies from COVID subsidies has raised constitutional concerns.

The Higher Regional Court of Vienna apparently saw this differently. The court qualified an application for legal aid for the purpose of suing for undisbursed subsidies as “wanton”. It considered concerns about the exclusion of “tax evaders” to be unfounded. Our Partner Kerstin Holzinger outlined in an article by Christine Kary in the daily newspaper Die Presse why the chances for excluded companies that dare to take legal action directly before the Constitutional Court may have increased as a result of this decision.
