Lately, the daily newspaper “Die Presse” included a section specifically on compliance and public procurement law. It comprised an interview with our Partners Alexander Hiersche (Team Antitrust and State Aid) and Kerstin Holzinger (Team Public Procurement Law), in which they provided information on questions of public procurement “self-cleaning” of companies after antitrust violations and the importance of compliance programs.
Both come to the conclusion that the Austrian legislator implemented European provisions on the requirements for a successful “self-cleaning” in a very strict way (“gold-plating”), which does more harm than good to competition in tendering procedures. Therefore, they take the view that the national legislator should rethink the legal framework.
