RdU & ZVG: events, developments, and future directions

In the latest issue of the specialist journal Recht der Umwelt – RdU (Environmental Law – RdU) (6/2025), Wilhelm Bergthaler addresses the topic “Future Directions in Environmental Mediation – Using the Example of the Vienna Airport Mediation.” In the journal Zeitschrift der Verwaltungsgerichtsbarkeit (Journal of Administrative Jurisdiction), Tamara Huber publishes the News Radar on current events and developments in legislation.

Future directions in environmental mediation – using the example of the Vienna airport mediation

New initiatives for infrastructure expansion, the energy transition, and industrial transformation also require new instruments for consensus-building. In short: Everything is expected to move faster. National and international initiatives are broadening the traditional understanding of public involvement – from procedural involvement to active engagement in project implementation, and even to a stake in the project itself. This puts public law under pressure: What options does procedural law offer to accommodate these new forms of consensus? With the Vienna Airport Dialogue Forum, an innovative model was developed early on that explored the boundaries between public and private-law consensus-building. Disputes frequently arise at these boundaries, which are examined in detail in the article. In doing so, the contours for the further development of consensual, democratic decision-making processes – and thus also the potential for acceleration – in public-law proceedings become visible.
