Consequences of assemblies – from a criminal and administrative criminal law perspective

The topic of the ÖRAK Fundamental Rights Day 2024 (“Freedom of assembly and demonstration in a democratic constitutional state”) and the general question of the legal consequences of assemblies are highly political. Andrea Concin and Bernd Wiesinger took this opportunity to transcribe their lecture from this year’s ÖRAK – Austrian Bar Association Fundamental Rights Day (WU – Vienna University of Economics and Business) – and were pleased to have it published in the current issue of the Anwaltsblatt (MANZ Verlag).

They explain that (mis-)conduct during assemblies can, under certain circumstances, be punished under both criminal law and administrative criminal law. However, the law requires a very precise examination in each case to determine who can be held accountable for what actions and how. Whether the mere participation in an unregistered assembly can be punishable is discussed in detail here in AnwBl 2024/9.
