No energy transition without energy storage! Despite their crucial role in transforming the energy sector, energy storage systems still lack a dedicated facility law and a well-established regulatory framework that adequately addresses the specific characteristics of various technologies. Instead, regulations are scattered across multiple levels and legal domains, with little apparent coherence at first glance. This raises the question: Have energy storage systems been overlooked in legal frameworks designed for the expansion of renewable energies, which primarily focus on energy producers? Are they a “blind spot” in the energy transition? An analysis of the various regulatory complexes, as presented in this article, reveals that there are useful starting points for a privileged licensing regime for energy storage \u2013 to accelerate the transformation process \u2013 in current law, albeit with room for improvement. At the same time, key criteria emerge that could guide future legal developments.<\/p>\n\n\n\n
