{"id":18533,"date":"2024-09-16T09:57:02","date_gmt":"2024-09-16T07:57:02","guid":{"rendered":"https:\/\/www.haslinger-nagele.com\/?p=18533"},"modified":"2025-01-30T10:01:46","modified_gmt":"2025-01-30T09:01:46","slug":"changes-to-the-finstrg-avoiding-financial-criminal-law-consequences","status":"publish","type":"post","link":"https:\/\/www.haslinger-nagele.com\/en\/changes-to-the-finstrg-avoiding-financial-criminal-law-consequences\/","title":{"rendered":"Changes to the FinStrG \u2013 avoiding financial criminal law consequences"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.parlament.gv.at\/gegenstand\/XXVII\/BNR\/990\" target=\"_blank\" rel=\"noreferrer noopener\">Fraud Prevention Act 2024<\/a> has significantly amended the provision of section <a href=\"https:\/\/ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10003898&amp;Artikel=1&amp;Paragraf=30a&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">30a FinStrG<\/a>, which stipulates a reason for the annulment of a penalty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Previously, tax authorities were already able to impose a tax increase of 10% (&#8220;Verk\u00fcrzungszuschlag&#8221;) if they identified an additional claim during a tax audit and suspected a financial offense, provided certain conditions were met. By paying the tax arrears and tax increase on time, it was possible to avert prosecution under financial criminal law (reason for annulment section 30a para. 1 FinStrG).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The determination of the reduction surcharge is at the discretion of the authority and requires that<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>there is a suspicion of a financial offense \u2013 not listed in section 30a para. 5 FinStrG \u2013 concerning the inaccuracies justifying the additional claim,<\/li>\n\n\n\n<li>the total amount does not exceed EUR 33,000,<\/li>\n\n\n\n<li>the reduction surcharge is applied for no later than 14 days after the additional tax claim is imposed, and<\/li>\n\n\n\n<li>there is a waiver of any appeal against the imposition of the tax increase<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The reason for annulment of the penalty becomes effective if payment of the tax arrears and tax increase is made within one month.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.parlament.gv.at\/gegenstand\/XXVII\/BNR\/990\" target=\"_blank\" rel=\"noreferrer noopener\">Fraud Prevention Act 2024<\/a> has now introduced important innovations:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Abolition of the previous EUR 10,000 limit: The previous strict annual limit of EUR 10,000 has been abolished. The removal of the annual limit of EUR 10,000 increases flexibility in the application of the reduction surcharge and is therefore to be welcomed.<\/li>\n\n\n\n<li>Payment facilitations: It is now possible to allow the imposition of a tax increase even when granting payment facilitation of up to six months for the affected tax claim. This is intended to facilitate the application of the provision.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The exemption from <a href=\"https:\/\/ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10003898&amp;Artikel=1&amp;Paragraf=30a&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">punishment under section 30a para. 1 FinStrG<\/a> can be used to avoid consequences under financial criminal law that might otherwise arise, such as a conviction for a financial offense.
