{"id":12244,"date":"2022-02-13T14:40:00","date_gmt":"2022-02-13T13:40:00","guid":{"rendered":"https:\/\/www.haslinger-nagele.com\/?p=12244"},"modified":"2022-04-13T14:49:38","modified_gmt":"2022-04-13T12:49:38","slug":"independence-of-regulatory-authorities-in-the-energy-sector","status":"publish","type":"post","link":"https:\/\/www.haslinger-nagele.com\/en\/independence-of-regulatory-authorities-in-the-energy-sector\/","title":{"rendered":"Independence of regulatory authorities in the energy sector"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The ECJ ruling C-718\/18 was handed down last year and has since sparked numerous discussions among energy law experts. But what exactly has been causing so much turmoil? The ECJ essentially dealt with the question of how independent the national regulatory authorities in the energy sector have to be and came to the conclusion that the German regulatory system \u2013 due to a lack of independence of the German regulatory authority (Federal Network Agency) \u2013 violated Union law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a recent article in the journal &#8220;<a href=\"https:\/\/www.manz.at\/produkte\/zeitschriften\/oejz\" target=\"_blank\" rel=\"noreferrer noopener\">\u00d6JZ<\/a>&#8221; (<em>Hartlieb\/ Nigmatullin<\/em>, German Energy Industry Act partially violates Union law: Signal effect for Austrian energy regulation? <a href=\"https:\/\/www.haslinger-nagele.com\/wp-content\/uploads\/2022\/02\/OEJZ_2022-04.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">\u00d6JZ 2022<\/a>, 246), Johannes Hartlieb and Emil Nigmatullin take a closer look at this ruling and its possible impact on Austrian energy regulation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">ECJ \u2013 Key Lessons<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The ECJ essentially stated that an overly far-reaching determination of the regulatory discretion set out in Union law by the national legislator contradicts Union law. Moreover, in view of the detailed EU legal framework regarding network access and tariff methodologies, there is no need to define (separate) criteria for tariff calculation at the national level. For these reasons, the ECJ ultimately considered the German regulatory system to be contrary to Union law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Implications for Austrian energy regulation?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A comparison of the tariff-setting provisions in the <a href=\"https:\/\/www.ris.bka.gv.at\/GeltendeFassung.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=20007045\" target=\"_blank\" rel=\"noreferrer noopener\">ElWOG 2010<\/a> and <a href=\"https:\/\/www.ris.bka.gv.at\/GeltendeFassung.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=20007523\" target=\"_blank\" rel=\"noreferrer noopener\">GWG 201<\/a>1 with the corresponding provisions in Germany shows that the Austrian legal bases provide far fewer detailed specifications for the determination of network charges by the E-Control. Accordingly, the E-Control has much more leeway to independently set tariffs \u2013 as required by the ECJ \u2013 than the Federal Network Agency. However, it cannot be entirely ruled out that individual provisions in the ElWOG 2010 and the GWG 2011 unduly restrict the regulatory discretion of the E-Control. In the future, the legislator will therefore have to carefully examine the extent to which there is room for statutory remuneration regulation, not least in view of the increasingly detailed legal framework of the Union.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The present ECJ ruling shows once again that numerous difficult legal issues can arise in the area of network regulation in the energy sector \u2013 also against the background of the energy transition.
