Antitrust law and proportionality"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">In the<a href=\"https:\/\/research.owlit.de\/document\/926f608b-9b92-37cd-b4f9-79aacedaa7df\" target=\"_blank\" rel=\"noreferrer noopener\"> current issue of the journal &#8220;Wirtschaft und Wettbewerb&#8221;<\/a>, our expert <a href=\"https:\/\/www.haslinger-nagele.com\/en\/team\/johannes-hartlieb\/\" target=\"_blank\" rel=\"noreferrer noopener\">Johannes Hartlieb<\/a> examines the role of commitments in European antitrust law under the influence of recent ECJ case law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Commitments are a popular instrument used by competition authorities to bring antitrust proceedings to a swift conclusion. A cartel fine is thereby avoided, so that the procedure also has significant advantages for the companies. However, an unrestrained use is not permissible. As Johannes Hartlieb points out in his monograph, the principle of proportionality imposes strict limits on the competition authorities&#8217; use of commitments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This was confirmed by a recent ECJ ruling on the inadmissibility of geo-blocking practices in the pay-TV sector.
